Sponsor Licence

If your business wants to recruit workers from overseas, you may need to obtain a sponsor licence from the Home Office.

At Azarmi Law, we advise businesses throughout the sponsor licence process - from assessing whether your organisation is eligible and reviewing your existing HR systems to preparing the application and supporting documentation.

We understand that obtaining a sponsor licence is often part of a wider recruitment or growth strategy. Our advice therefore considers not only the application itself, but also the ongoing responsibilities your business will take on as a licensed sponsor.

Whether you are applying for your first sponsor licence, planning to recruit a particular overseas worker or want advice on the sponsorship process, our Corporate Immigration team can assist.

Does My Business Need a Sponsor Licence?

Your business will usually need a sponsor licence if you want to employ a worker from overseas who does not already have permission to work in the UK in the role you are offering.

Not every overseas worker requires sponsorship. For example, a sponsor licence is generally not required to employ Irish citizens, individuals with settled or pre-settled status under the EU Settlement Scheme, or those who hold indefinite leave to remain.

Where sponsorship is required, your business must normally obtain the appropriate sponsor licence before it can sponsor the worker. You will then need to ensure that the proposed role and worker meet the requirements of the relevant immigration route.

For businesses recruiting under the Skilled Worker route, this means considering matters such as the eligibility of the role, applicable salary requirements and the assignment of a Certificate of Sponsorship.

If you have identified an overseas candidate but are unsure whether your business needs a sponsor licence, Azarmi Law can assess your circumstances and advise on the appropriate route forward.

Can My Business Get a Sponsor Licence?

Businesses must meet certain Home Office requirements before they can obtain a sponsor licence. The requirements will depend on your organisation, the roles you intend to sponsor and your individual circumstances.

The Home Office will consider whether your business is eligible and suitable to become a licensed sponsor, including whether you have appropriate systems in place to meet your ongoing sponsorship duties.

Not sure whether your business qualifies?

At Azarmi Law, we can assess your circumstances, identify any potential issues and guide you through the sponsor licence process from the outset.
